Terms and Conditions

1. Scope of application

For the purposes of these general terms and conditions of sale, the following definitions shall apply:

  • Customer: Every natural and legal person who enters into an agreement with MORPH Studios for the purpose of delivering goods.
  • Goods: All goods and services that are the subject of these general terms and conditions of sale or the sales agreement.
  • Sales agreement: The agreement concluded between MORPH Studios and the Customer with the object of delivering goods at a price to be paid by the Customer, governed by these General Terms and Conditions of Sale.
  • MORPH Studios: MORPH studios, with registered office at Hassaluthdreef 10B bus 7, 3500 Hasselt and with VAT-number BE0753.830.946

2. Scope of application

2.1 These general terms and conditions apply to all sales agreements concluded with MORPH Studios. When placing an order, the Customer expressly accepts these general terms and conditions of sale unless departures are stipulated in writing.

2.2 Should one or more points in these general terms and conditions of sale be declared void, invalid or illegal, this shall in no way affect the validity, legality and applicability of the other provisions in the agreement.

2.3 MORPH Studios reserves the right to amend and/or supplement these general terms and conditions of sale at any time for future orders. However, any future amendment will not affect orders already placed and related agreements.

2.4 The Customer expressly acknowledges that an order via e-mail, Whatsapp or any other electronic means of communication has the same value as an order transmitted in writing.

3. Price and Payment

3.1 All prices stated are expressed in EURO, always including VAT and all other duties or taxes to be borne by the Customer.

3.2 If delivery, reservation or administrative costs are charged, this will be stated separately.

3.3 The Customer must pay the amount due immediately and in full when placing an order.

4. Orders

4.1 The sales agreement comes into effect and is binding after payment for the goods.

4.2 MORPH Studios is entitled to refuse orders or attach special conditions to them if there are good reasons to do so.

4.4 Offers included in brochures, price lists, documentation or website are not considered binding towards MORPH Studios. This applies both to the prices quoted, the description, and the delivery period.

4.5 The Customer is at all times personally responsible for checking and approving the order.

4.6 MORPH Studios reserves the right to limit the quantities of any products that MORPH Studios offers. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of MORPH Studios. MORPH Studios reserves the right to discontinue any product at any time. 

5. Deliveries

5.1 The estimated delivery time is displayed at the time of the order. MORPH Studios will endeavor to deliver the ordered goods on time. The Customer acknowledges that - unless explicitly agreed otherwise - this delivery date is purely indicative. Non-compliance with this indicative deadline by MORPH Studios can under no circumstances give rise to the dissolution of the agreement or to any right to compensation at the expense of MORPH Studios.

5.2 The goods will only be delivered after payment of the price by the Customer.

5.3 Delivery takes place at the address indicated by the Customer, unless otherwise agreed in writing.

6. Return Policy

6.1 In accordance with the law of 30 December 2013 on Book VI of the Code of Economic Law concerning market practices and Customer protection, Customers have the right to notify MORPH Studios via email within 14 calendar days of receiving a product if they wish to withdraw from their purchase.

6.2 MORPH Studios strongly recommends that Customers return products in their original packaging and in perfect condition. If a returned item is damaged, MORPH Studios reserves the right to seek compensation from the Customer corresponding to the diminished value of the item (Article VI.51, §2 WER). Returns with unidentified senders will be refused.

6.3 The costs and responsibility for the return are borne by the Customer. After registering your return, the Customer has 14 calendar days to return the parcel to an appropriate parcel point.

6.4 MORPH Studios advises using a courier service with a Track and Trace option to ensure the return is traceable. MORPH Studios is not liable for the refund of goods that are lost, stolen, or damaged during the return process.

6.5 Refunds will be issued within 14 days of MORPH Studios receiving the returned item, provided all conditions outlined above are strictly met, in accordance with Article VI.50 §1-§3 WER.

6.6 Certain items, such as custom products (e.g., special orders or personalized items) and personal care goods (e.g., beauty products), cannot be returned. 

Please note that sale items and gift cards are also not eligible for returns.

8. Liability

The Customer shall immediately and comprehensively notify MORPH Studios of any event or situation that may give rise to a claim or request against MORPH Studios by a third party that may significantly affect the performance of this agreement.

9. Intellectual property

9.1 Our website, logos, texts, photos, names and in general any expression is the property of Morph Studios.

9.2 It is prohibited to use and/or modify the intellectual property rights as described in this article. For example, drawings, photographs, names, texts, logos, colour combinations, etcetera ... may not be copied or reproduced without prior and express written consent.

9.3 Any infringement will result in a claim for damages, to be determined individually on a case-by-case basis and may also result in a lawsuit, for which only the Court of Hasselt is competent, applying Belgian law.

9.4 By submitting comments, ideas, or materials to us, the Customer grants MORPH Studios the right to edit, publish, and use them in any medium without restriction or compensation. MORPH Studios is not obligated to maintain any submissions confidential, or to respond to it. MORPH Studios reserves the right to monitor and remove content deemed inappropriate or in violation of intellectual property rights. MORPH Studios agrees not to submit comments that infringe on third-party rights, contain unlawful or harmful material, or mislead us or others.

10. Complaints and Defects

10.1 Any non-conformity of the delivered good, as described in the sales contract or the mentioned documents is hereinafter referred to as ‘defect’.

10.2 The Customer is expected to thoroughly examine the goods. Complaints and visible defects of the delivered goods must be communicated to MORPH Studios explicitly, unequivocally and justified in writing within eight (8) days after delivery. Failing this, the Customer declares that the goods are move-in ready and free of all visible defects. The Customer also declares that the goods are consistent with what is stipulated in the sales contract.

10.3 Are not considered defects and are therefore not covered by the warranty:

  • Discolouration of the goods, insofar as such discolouration cannot be prevented or is generally accepted according to custom or is peculiar to the materials used.
  • Damage caused by normal wear and tear and unintentional or deliberate changes made by the Customer to the goods.
  • Studios have made every effort to display as accurately as possible the colors and images of our products that appear at the store. MORPH Studios cannot guarantee that a computer monitor's display of a color will be accurate.

10.4 In case of hidden defects, MORPH Studios is only obliged to repair and, to the extent repair is not possible or not desirable, to replace the delivered good. MORPH Studios shall only provide a guarantee for hidden defects up to 6 months after delivery. MORPH Studios can only be held liable for damage to the delivered goods themselves, as a result of possible hidden defects, to the exclusion of all other damages. MORPH Studios cannot be held responsible for gross negligence or fraud of its employees. The guarantee is not transferable.

10.5 MORPH Studios is not responsible for incorrect orders due to incorrect information provided by the Customer.

11. Warranties

11.1 Without prejudice to the right of renunciation, Customers may invoke all legal warranties associated with the products on our website.

11.2 MORPH Studios guarantees that the products match the order and meet the normal expectations given the specifications of the product.

11.3 MORPH Studios is not liable for technical data provided by the manufacturer or delivery company.

11.4 Customers will receive a refund for the products if, with valid proof, they do not meet the normal standards of the product or have a hidden defect. 

12. Transfer

12.1 MORPH Studios is entitled to transfer all or part of its rights and obligations under this agreement to third parties.

12.2 MORPH Studios will keep and store certain data of the Customer (written and electronic) as part of normal Customer management. Any financial information (bank account numbers, credit card numbers and the like) will only be used by MORPH Studios in the processing of payments. Under no circumstances will MORPH Studios make the Customer's data available to third parties. Upon written request, the Customer shall have access to this information.

13. Optional tools

13.1 MORPH Studios may offer the Customer access to third-party tools, which MORPH Studios does not monitor, control, or influence in any way. The Customer acknowledges that these tools are provided "as is" and "as available," without any warranties, representations, or endorsements of any kind. MORPH Studios disclaims all liability arising from or related to the use of these optional third-party tools.

13.2 The use of these tools is entirely at risk and discretion of the Customer, and it is the responsibility of the Customer to review and accept the terms provided by the relevant third-party provider(s).

13.3 Additionally, MORPH Studios may introduce new services, features, tools, or resources through their website in the future. These new offerings will also be governed by these Terms of Service.

14. Third Party Links 

14.1 Some content, products, and services accessible through our platform may include materials from third parties.

14.2 Links on our site may direct the Customer to third-party websites that are not affiliated with us. MORPH Studios does not review or warrant the content or accuracy of these websites, nor does MORPH Studios assume any responsibility or liability for third-party materials, products, services, or websites.

14.3 MORPH Studios is not liable for any harm or damages arising from the purchase or use of goods, services, resources, content, or any other transactions conducted through third-party websites. Before engaging in any transaction, please carefully review the third party's policies and practices. Any complaints, claims, concerns, or questions regarding third-party products should be directed to the respective third party.

15. Jurisdiction

15.1 These terms of sale are governed by Belgian law irrespective of the place of residence of the Customer.

15.2 All disputes relating to the performance or interpretation of the contractual relationship between the parties shall fall within the exclusive jurisdiction of the courts of the district of Antwerp, Hasselt division.
